Pipedrive Acceptable Use Policy

Scope and Acceptable Use

This Pipedrive Acceptable Use Policy (“Policy”) applies to Clients’ and Users’ (“You” or “Your”) use of all services offered by Pipedrive, or any other of their Affiliates (“Pipedrive”). Capitalized terms used herein but not defined in this Policy have the meaning set forth in the Pipedrive Terms of Service (located at https://www.pipedrive.com/en/terms-of-service) (“TOS”). This Policy is designed to prevent the misuse or abuse of Pipedrive products or Services including the Pipedrive Platform, all Pipedrive websites, and any other products or services made available by Pipedrive (“Offerings”). You may only use the Offerings in accordance with this Policy and applicable law.

Policy Updates

Pipedrive may make changes to this Policy by posting a revised version of the Policy at www.pipedrive.com, and such updates will be effective upon posting.

Policy Breaches

Although Pipedrive has listed a number of prohibited activities below that it considers misuse or abuse of the Offerings, the list is not comprehensive. You may not use the Offerings in violation of the express prohibitions below, the TOS or in violation of the spirit of this Policy. Pipedrive, in its sole discretion, shall have the right to immediately terminate or suspend the access to, or use of the Pipedrive Services without notice or liability to You if You, or any person employed by or affiliated with You, takes any action in violation of this Policy or the spirit of this Policy, or if Pipedrive determines, in its sole discretion, that Your continued use of the Pipedrive Services may violate any federal, state, or local, law, rule, or regulation.

Prohibited Materials and Activities

In addition, and without limiting the other requirements in this Policy or the TOS, You may not (directly or indirectly), and as solely determined by Pipedrive, use the Pipedrive Services with content, or in a manner that:

  1. commits a crime, breaches any applicable law, or entices or invites others to carry out such illegal actions;

  2. is deceptive, false, fraudulent, inaccurate, or misleading;

  3. provides, sells, or offers to sell the following products or content (or services related to the same): pornography or illicitly pornographic sexual products; escort services; illegal goods; illegal drugs; illegal drug contraband; pirated computer programs; firearms, bombs, grenades, or other weapons;

  4. displays material that exploits children under 18 years of age;

  5. infringes a third party's intellectual property right(s), including without limitation distributing any software, music, videos, images, or other material protected by intellectual property laws (or by rights of privacy or publicity) unless You have all necessary rights and consents to do so;

  6. harvests or otherwise collects information about others, including without limitation email addresses, without the express, verifiable approval from a recipient to receive marketing communication and provides, sells, or offers to sell, or rent any mailing list;

  7. offers or promotes lead generation services, which resells or requests to purchase customer data;

  8. provides, sells, or offers products, services, or content frequently associated with unsolicited commercial email, a.k.a. spam, such as without limitation online pharmacies, pharmaceutical products, nutritional supplements, herbal supplements, vitamin supplements, weight loss, dating services, horoscopes, numerology, work at home businesses, credit or finance management, mortgage, and debt relief offers;

  9. produces, sells, exchanges, stores, or markets of cryptocurrencies or initial coin offerings;

  10. provides material that is grossly offensive, vulgar, obscene, indecent or unlawful material, including without limitation blatant expressions of bigotry, prejudice, racism, hatred, or excessive profanity or post any obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable content;

  11. posts or discloses any personally identifying information or private information about any person (including children) without their Consent (or their legal guardian’s Consent in the case of a minor);

  12. sells or promotes any products or services that are unlawful in the location at which the content is posted or received;

  13. uploads files that contain viruses, corrupted files, or any other similar software or programs, including without limitation viruses, malware, worms, harmful code, and/or Trojan horses, that may damage the operation of another person's computer;

  14. markets or promotes any form of online or offline gambling, including without limitation introduction and advertising online trading, day trading tips, penny stock or stock market & business investment-related content;

  15. is for the purposes of affiliate marketing;

  16. promotes, solicits, or participates in pyramid schemes or multi-level marketing (MLM) businesses;

  17. engages in any libelous, defamatory, scandalous, threatening, harassing activity;

  18. posts any content that advocates, promotes or otherwise encourages violence against any governments, organizations, groups or individuals or which provides instruction, information, or assistance in causing or carrying out such violence, including without limitation promoting, facilitating or instructing others to engage in illegal activity;

  19. is in violation of any applicable local, state, national or international law or regulation, including without limitation all export laws and regulations and without limitation the Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM Act) (15 U.S.C. § 7701 et seq.), the U.S Telephone Consumer Protection Act of 1991 (47 U.S.C. § 227), the Do-Not-Call Implementation Act of 2003 (15 U.S.C. § 6152 et seq.; originally codified at § 6101 note), the General Data Protection Regulation (2016/679), the Directive 2000/31/EC of the European Parliament and Council of 8 June 2000, on certain legal aspects of information society services, in particular, electronic commerce in the Internal Market ('Directive on Electronic Commerce'), along with the Directive 2002/58/EC of the European Parliament and Council of 12 July 2002, concerning the processing of personal data and the protection of privacy in the electronic communications sector ('Directive on Privacy and Electronic Communications'), regulations promulgated by the U.S. Securities Exchange Commission, any rules of national or other securities exchange, including without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, the Personal Information Protection and Electronic Documents Act (PIPEDA) (S.C. 2000, c. 5), Canada’s Anti-Spam Legislation (CASL) (S.C. 2010, c. 23), Japan’s Act on Regulation of Transmission of Specified Electronic Mail (Act No. 26 of April 17, 2002) and any regulations having the force of law or laws in force in Your or Your email recipient's country of residence;

  20. is in violation of Your third-party vendors’ and service providers’ terms of use, including any email service provider; or

  21. compromises the security or operation of Pipedrive systems or Offerings.
